Welcome to Petwrk! These Terms and Conditions ("Terms") govern your access to and use of the Petwrk mobile application, website, and related services ("Service" or "App"), operated by Petwrk, LLC ("we," "us," or "our").

By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the Service. You will be required to explicitly accept these Terms during signup by checking a box that states:

"I have read and agree to Petwrk's Terms and Conditions and Privacy Policy."

This action constitutes your legal acknowledgment and agreement.

Eligibility

You must be 18 years old to use the app. If you lie about your age we will have the right to delete your account and press charges.

Account Registration and Responsibilities

To use certain features of Petwrk, you must create an account. You agree to:

• Provide accurate and complete registration information;
• Keep your login credentials secure;
• Not share your account with others; and
• Notify us immediately of any unauthorized use or breach of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.

Use of the Service

You may use Petwrk only for lawful and intended purposes. You agree not to:

• Violate any applicable laws or regulations;
• Use the App to harass, stalk, defame, or harm others;
• Post offensive, false, or misleading content;
• Infringe on others' intellectual property or privacy rights;
• Use automation, scraping, or bots to access or manipulate the Service; and
• Share or promote spam, advertisements, or unauthorized solicitations.

We reserve the right to remove content, restrict features, or suspend users who violate these rules.

User Content and License

You own the content you post, including photos, profiles, and pet information. However, by uploading content to Petwrk, you grant us a worldwide, royalty-free, non-exclusive, sublicensable license to:

• Display, distribute, and reproduce your content within the App and affiliated promotional content; and
• Use your content to improve and market the App.

You are responsible for the legality and accuracy of your content and must ensure that you have rights to post it.

Moderation and Community Safety

Petwrk has a zero-tolerance policy for abuse. We reserve the right to:

• Review reported content and user behavior;
• Remove content that violates these Terms;
• Ban users who post harmful or inappropriate material; and
• Cooperate with law enforcement as needed.

We aim to foster a positive, inclusive, and safe community for pet lovers.

Intellectual Property

All non-user-generated content in the App (including our logo, branding, interface, and software code) is the exclusive property of Petwrk LLC and protected by copyright, trademark, and other laws.

You may not:

• Copy, reproduce, or redistribute Petwrk's content without written permission; and
• Use our name, brand, or likeness to impersonate or misrepresent affiliation.

Feedback and Suggestions

If you submit feedback or ideas to improve Petwrk, you grant us full rights to use that feedback for any purpose without compensation or restriction. We are not obligated to act on your feedback.

Third-Party Services

Petwrk may integrate third-party tools such as:

• Maps and location services;
• Analytics and performance monitoring; and
• Social media sharing features.

Your use of these features is subject to their respective privacy policies and terms of use. We are not responsible for third-party services.

Termination of Use

We may suspend or terminate your access to Petwrk without notice if:

• You breach these Terms;
• Your behavior endangers the community; and
• You are inactive for a prolonged period

You may close your account anytime via in-app settings or by contacting petwrktheapp@phoenixlarocco.com. Termination does not affect rights granted before your account closure.

Disclaimers

Petwrk is provided "as is" and "as available." We do not guarantee:

• Continuous, error-free, or secure operation of the App;
• Accuracy of user-generated content; and
• That the App will meet your expectations or be compatible with your device.

Use of Petwrk is at your own risk.

Limitation of Liability

To the fullest extent permitted by law:

• Petwrk shall not be liable for indirect, incidental, or consequential damages, including loss of data, reputation, or profits.
• Our liability is capped at the amount you've paid for the Service (if any), or $100, whichever is lower.

Copyright Complaints (DMCA)

We respect intellectual property rights. If you believe that content on Petwrk infringes your copyright, send a detailed DMCA notice to: petwrktheapp@phoenixlarocco.com

Include:

• A description of the infringing work;
• A link or location of the content; and
• Your contact information and good faith statement.

We will review and act as appropriate, including content removal.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA.

In the event of a dispute, you agree to first attempt to resolve it informally with us. If unresolved, disputes will be handled in the courts of Newark, Delaware or through legally recognized arbitration.

Compliance and Export Control

You represent that:

• You are not located in a country subject to U.S. embargo laws; and
• You are not on any U.S. government list of restricted or prohibited parties.

Use of the App must comply with all applicable export and sanctions laws.

Modifications to Terms

We may revise these Terms at any time. If we make material changes, we will notify users through:

• In-app notice; and
• Email (if provided).

Continued use of the App after updates means you accept the new Terms. The latest version will always be available at https://landing.dev.petwrk.app/terms-and-conditions.

Severability and Waiver

If any part of these Terms is found invalid or unenforceable, the rest of the Terms remain in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.
